What Is a Performance Bond (Bank Guarantee) in Construction?
A performance bond is a guarantee, usually issued by a bank or insurer on the contractor's behalf, that pays the employer up to a stated amount if the contractor fails to meet its obligations under the contract. It is a common form of security alongside retention.
How a performance bond works
The contractor asks a bank or insurer to issue the bond in favour of the employer. The bond sets an amount, usually a percentage of the contract price, and an expiry or release condition. If the contractor defaults and the employer makes a valid demand under the bond's terms, the issuer pays and then recovers from the contractor.
Common types of bond and guarantee
A project can involve several instruments:
- Tender (bid) bond: supports the offer during the tender period.
- Performance bond: secures delivery of the works.
- Advance payment guarantee: secures an advance until it is recovered.
- Retention bond: replaces cash retention where the contract allows.
Validity, expiry and cost
A bond only protects the employer while it is valid, so the expiry date, extensions and the conditions for release or reduction must be tracked. The issuer charges a fee, normally a yearly percentage of the bond value, and may require collateral or reduce the contractor's credit lines. Our bond and guarantee calculator estimates the cost for a given amount and period.
Bonds on Gulf projects
Gulf employers commonly require bank guarantees from banks acceptable to them, in the wording set out in the contract. The amount, the form (on-demand or conditional), the validity and the release trigger vary by contract, so always follow the wording and timing stated in your documents.

Frequently asked questions
What is the difference between a performance bond and a bank guarantee?
A bank guarantee is the instrument issued by a bank. A performance bond is the purpose: security for performance. In practice the two terms are often used for the same document.
What does an on-demand guarantee mean?
It can be called by the beneficiary on a written demand without proving the default first, subject to the bond's wording. A conditional bond requires the stated conditions to be shown.
When is a performance bond released?
On the event stated in the contract or the bond, commonly at completion or after the defects period. Release is not automatic, so the original is returned or the beneficiary confirms release in writing.
